TERMS OF SERVICE AGREEMENT

PLEASE READ THIS TERMS OF SERVICE AGREEMENT CAREFULLY. BY USING THIS WEBSITE, DOWNLOADING THE RESTRA'NT APP, OR ORDERING OPTIONAL HARDWARE FROM THIS WEBSITE, YOU AGREE TO BE BOUND BY ALL OF THE TERMS AND CONDITIONS OF THIS AGREEMENT.

This Terms of Service Agreement (the "Agreement") governs your use of this website, RestrantApp.in (the "Website"), your use of the free Restra'nt App on Google Play, and any optional thermal-printer hardware ("Products") you purchase from us via WhatsApp as described on this Website. Company means "ProGalaxy eLabs Private Limited".

I. THE APP AND PRODUCTS

The App. Restra'nt App is free to download and use, with no subscription or purchase required. It works offline and stores your data on your own device; we do not operate a server that receives your business data.

Optional Hardware. This Website offers optional thermal-printer hardware ("Products") for sale via WhatsApp order. By placing an order for Products, you agree to the terms set forth in this Agreement.

Proprietary Rights. Company has proprietary rights and trade secrets in the App and Products. You may not copy, reproduce, resell or redistribute any Product manufactured and/or distributed by Company, or reverse-engineer the App.

Sales Tax. If you purchase any Products, you will be responsible for paying any applicable sales tax.

II. WEBSITE

Use of Website. Company is not responsible for any damages resulting from use of this website by anyone. You will abide by all applicable laws, not interfere with other users, not resell material on the Website, and not transmit spam.

License. By using this Website, you are granted a limited, non-exclusive, non-transferable right to use the content and materials on the Website in connection with your normal, noncommercial use.

III. DISCLAIMER OF WARRANTIES

YOUR USE OF THIS WEBSITE AND/OR PRODUCTS ARE AT YOUR SOLE RISK. THE WEBSITE AND PRODUCTS ARE OFFERED ON AN "AS IS" AND "AS AVAILABLE" BASIS.

IV. LIMITATION OF LIABILITY

COMPANY'S ENTIRE LIABILITY IS SOLELY LIMITED TO THE AMOUNT YOU PAID, LESS SHIPPING AND HANDLING, FOR PRODUCTS PURCHASED VIA THE WEBSITE.

V. INDEMNIFICATION

You will release, indemnify, defend and hold harmless Company from all liabilities, claims, damages, costs and expenses arising out of your breach of this Agreement or use of the Website/Products.

VI. PRIVACY

Please refer to Company's privacy policy, incorporated by reference herein.

VII. GENERAL

Governing Law, Jurisdiction. This Agreement is governed by the laws of the State of Andhra Pradesh. Any suit must be brought in courts located in Andhra Pradesh.

Statute of Limitation. Any claim must be filed within one (1) year after it arose or be forever barred.

Waiver of Class Action Rights. You irrevocably waive any right to join claims with those of others in a class action.

Termination. Company may terminate your access for breach of these terms, without advance notice.

Domestic Use. Company makes no representation that the Website or Products are available for use outside India.
